Terms of Use
These terms cover your use of the Atlas Health website and membership. Atlas provides non-clinical membership services. Your medical care is provided by independent licensed clinicians under their own terms, which we point to below.

Agreement to these terms
These Terms of Use (“Terms”) are an agreement between you and Atlas Health LLC (“Atlas,” “we,” “us”), a California limited liability company providing non-clinical membership services. They govern your use of https://joinatlashealth.com, our membership, and any content, tools, or services we provide (together, the “Services”).
By using the Services or joining a membership, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Who we are and who provides your care
Atlas provides non-clinical membership services. Those services include this website, intake coordination, order and shipment updates, education, coaching, and member support. Atlas does not practice medicine, employ clinicians, own medical records, or dispense medication.
Medical care for Atlas members is provided by OpenLoop Healthcare Partners, PC and its affiliated professional entities (together, “OpenLoop” or “your care team”). Their licensed clinicians decide whether telehealth is appropriate for you, whether to prescribe any medication, and how to manage your treatment. Your relationship with your care team is governed by OpenLoop’s Terms of Use and its Telehealth Consent, which you will be asked to accept before care begins.
Atlas receives a membership services fee. OpenLoop is the merchant of record for program charges.
Eligibility
You must be at least 18 years old, live in a state where the Services and clinical care are available, and be able to enter a binding contract. You must provide accurate, current, and complete information and keep it up to date.
Care through the Services is not available to everyone. Your care team decides whether you are a candidate based on your intake, your history, and any labs they require.
Your membership
An Atlas membership gives you access to non-clinical services: a guided intake, coordination with your care team, order and shipment tracking, educational content, coaching where offered, and member support.
A membership does not guarantee that you will be prescribed any medication or accepted into any program. Some programs require lab work before a clinician will make a decision.
We may change the features of the membership from time to time. If we make a change that materially reduces what you receive, we will tell you in advance and you may cancel.
Medical care and your care team
All medical decisions are made by independent licensed clinicians. Atlas has no authority over, and does not direct, any clinical decision. Your care team may decline to treat you, change or stop a treatment, or require additional information or labs at any time.
Telehealth has limits. It is not appropriate for every condition, and it does not replace in-person care when that is needed. If your care team determines that telehealth is not appropriate for you, they will tell you and may refer you elsewhere.
Prescription medications are dispensed by licensed pharmacies chosen by your care team. Some medications may be compounded. Compounded medications are prepared for an individual patient and are not approved by the U.S. Food and Drug Administration. Your care team will explain what you are prescribed and why.
Site content is not medical advice
Content on our site, in our emails, and in our coaching materials is for general information. It is not medical advice, diagnosis, or treatment, and it does not create a clinician-patient relationship. Do not rely on it in place of advice from your clinician. See our Medical Disclaimer for more.
If you think you are having a medical emergency, call 911 or go to the nearest emergency room. The Services are not for emergencies and are not monitored around the clock.
Your account
You are responsible for keeping your login details confidential and for everything that happens under your account. Tell us right away at info@joinatlashealth.com if you believe your account has been used without your permission. You may not share your account or use someone else’s.
Payments, billing, and renewals
Membership fees. Atlas charges a membership services fee at the interval shown when you join. Unless stated otherwise, memberships renew automatically at the end of each term until you cancel.
Program charges. Charges for clinical services and medication are set by OpenLoop, which is the merchant of record for those charges. Those charges may appear on your card statement under a descriptor that includes both names, such as “Atlas Health - OLH Health.”
Recurring charges. By providing a payment method, you authorize Atlas and OpenLoop, as applicable, to charge it for the amounts you agree to, including renewals, until you cancel. If a payment fails, we may retry it and may pause your membership until it is resolved.
Price changes. We may change membership fees with at least 30 days’ notice by email. The new fee applies at your next renewal after the notice period.
Taxes. Prices exclude taxes unless stated. You are responsible for any applicable taxes.
Cancellations and refunds
You can cancel at any time by emailing info@joinatlashealth.com. Cancellations and refunds are governed by the Refund and Cancellation Policy on our site, which reproduces the policy of OpenLoop as merchant of record. Cancellation requests must be received at least 72 hours before your billing date, and refunds are limited to the cases that policy describes.
Electronic communications and text messages
You agree to receive notices, agreements, and other communications from us electronically: by email, through the Services, or by text message where you have opted in. Electronic communications satisfy any legal requirement that they be in writing. You may withdraw consent to text messages by replying STOP. Message and data rates may apply. See our Privacy Policy for details on text messaging.
You agree that clicking a button, checking a box, or otherwise indicating acceptance through the Services has the same effect as a signature.
Acceptable use
You agree not to:
- use the Services for any unlawful purpose;
- provide false information, including about your identity or your health;
- seek care on behalf of another person without the authority to do so;
- attempt to obtain medication for anyone other than yourself;
- interfere with the security or operation of the Services;
- scrape, copy, or reverse engineer any part of the Services; or
- use the Services to harass or harm anyone.
Intellectual property
The Services, including text, graphics, logos, images, video, and software, belong to Atlas or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable license to use the Services for your own non-commercial purposes. You may not copy, modify, distribute, or create derivative works from any part of the Services without our written permission. Atlas Health and the Atlas logo are trademarks of Atlas Health LLC.
Third-party services and links
The Services rely on third parties, including your care team, pharmacies, laboratories, payment processors, and the coaching platform. Their services are governed by their own terms and policies. Our site may link to other websites. We do not control them and are not responsible for their content or practices.
Disclaimer of warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Atlas disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any program will produce a particular result. Nothing in this section limits any responsibility your care team has to you under its own agreements or applicable law.
Limitation of liability
To the fullest extent permitted by law, Atlas and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to the Services or these Terms.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services or these Terms will not exceed the membership fees you paid to Atlas in the twelve months before the claim arose.
Some jurisdictions do not allow these limitations, so they may not apply to you. This section does not limit liability for medical services, which are provided by your care team and not by Atlas.
Indemnification
You agree to defend, indemnify, and hold harmless Atlas and its members, managers, employees, and agents from claims, damages, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of another person.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law rules.
Before filing a claim, you agree to contact us at info@joinatlashealth.com and give us 30 days to try to resolve the issue informally. If we cannot resolve it, any claim must be brought in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts. Nothing in this section prevents either of us from seeking relief in small claims court or limits rights you have under law that cannot be waived.
Any claim arising out of these Terms or the Services must be filed within one year after it arises, unless applicable law requires a longer period.
Termination
You may stop using the Services or cancel your membership at any time. We may suspend or end your access if you violate these Terms, if we cannot verify your information, if required by law, or if we stop offering the Services. If we end your membership for a reason other than your breach, we will refund any prepaid membership fees for the unused portion of your term.
Sections that by their nature should survive, including payment obligations, disclaimers, limitations of liability, indemnification, and dispute terms, survive termination.
Your care team may end care under its own terms. Ending your Atlas membership does not by itself end your relationship with your care team. Contact them about any ongoing treatment.
Changes to these terms
We may update these Terms. When we do, we will change the effective date at the top of the page and, for material changes, notify you by email or by a notice on our site before the change takes effect. Your continued use of the Services after a change means you accept the updated Terms.
