Who we are and what this policy covers
Atlas Health LLC (“Atlas,” “we,” “us”) is a California company that provides a membership platform for people pursuing weight management, sexual health, hormone health, and related goals. We are not a medical practice. Medical care for Atlas members is provided by OpenLoop Healthcare Partners, PC and its affiliated professional entities (together, “OpenLoop” or “your care team”), whose licensed clinicians make every medical decision.
This policy applies to joinatlashealth.com, our membership, our emails and text messages, and any other place we link to it. It does not apply to your medical records. Those are created and held by OpenLoop and are governed by its Notice of Privacy Practices, available at https://openloophealth.com/notice-of-privacy-practices and summarized on our HIPAA page.
Two kinds of information
It helps to know that there are two kinds of information in the Atlas experience, and they are handled differently.
Membership and website information is what Atlas collects as a business: your contact details, account information, how you use our site, and the messages we exchange with you. This policy covers that information.
Protected health information is what your care team creates and holds when you receive care: your intake responses, visit notes, lab results, prescriptions, and treatment plan. OpenLoop is the HIPAA covered entity for that information. Atlas may access some of it only to support your care and membership, under a written business associate agreement that limits what we can do with it and requires us to protect it.
What we collect
Information you give us. When you create an account, complete a questionnaire, join a membership, or contact us, we collect your name, email address, phone number, mailing address, date of birth, and the answers you provide. Some questionnaire answers relate to your health. Payment card details are collected by our payment processor and by OpenLoop as merchant of record; Atlas does not store full card numbers.
Information collected automatically. When you use our site we collect device and browser information, IP address, pages viewed, links clicked, referring pages, and approximate location derived from your IP address. We use cookies, pixels, and similar tools for this. See the section on cookies and advertising below.
Information from others. We receive updates from OpenLoop about the status of your membership, such as whether an intake is complete or a shipment has left the pharmacy, so that we can support you. If you use a coaching app connected to your membership, we receive the information you enter there. We may receive information from analytics and advertising partners about how you found us.
How we use information
We use information to create and manage your account and membership; to hand your intake to your care team and keep you informed about its status; to provide non-clinical support, education, and coaching; to process payments and prevent fraud; to send service messages about your account, orders, and shipments; to send marketing messages when you have agreed to receive them; to understand how our site is used and improve it; to comply with law and enforce our terms; and to protect the safety and rights of our members, our team, and others.
We do not use your health information to make decisions about advertising to you, and we do not sell personal information.
Text messages
If you provide your mobile number and agree to receive text messages, we may send you account notifications, appointment and shipment updates, and, if you opt in separately, marketing messages. Message frequency varies. Message and data rates may apply. Reply STOP at any time to stop receiving messages and HELP for help. Carriers are not liable for delayed or undelivered messages. Your consent to receive text messages is not a condition of purchase.
Your choices
Email. You can unsubscribe from marketing email using the link in any message. We will still send service messages about your account and orders.
Text messages. Reply STOP to any message to opt out.
Account information. You can review and update your contact details by signing in to your account or by emailing info@joinatlashealth.com.
Cookies. See the cookies section above.
Medical records. Requests to access, correct, or obtain copies of your medical records go to your care team. See our HIPAA page for how to reach them.
Your California privacy rights
If you are a California resident, you may have the right to know what personal information we collect, use, and disclose; to request that we delete personal information we hold about you; to correct inaccurate personal information; to opt out of the sale or sharing of personal information (we do not sell personal information, and we do not share it for cross-context behavioral advertising in a way that uses your health information); to limit the use of sensitive personal information; and not to be discriminated against for exercising these rights.
To make a request, email info@joinatlashealth.com with the subject line “Privacy request.” We will verify your identity by matching the details you provide against the information in your account, and we will respond within the time required by law. You may authorize an agent to make a request for you; we will ask for proof of that authorization.
Some of the information you might expect to be covered here, such as your medical records, is protected health information held by OpenLoop and is governed by HIPAA and its Notice of Privacy Practices instead.
Residents of other states
Residents of states with comprehensive privacy laws may have similar rights to access, correct, delete, and obtain a copy of their personal information, and to opt out of targeted advertising or the sale of personal information. Use the contact details below to make a request, and we will honor the rights that apply to you. If we decline a request, we will tell you why, and you may appeal by replying to our response.
How we protect information
We use administrative, technical, and physical safeguards designed to protect information, including encryption in transit, access controls, and vendor agreements that require the same. No system is perfectly secure, and we cannot guarantee the security of information transmitted to us. If we learn of a breach affecting your information, we will notify you as required by law.
How long we keep information
We keep membership and account information for as long as you have an account and for a reasonable period afterward to comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. We keep questionnaire responses that we hold on behalf of your care team for as long as our business associate agreement requires. You can ask us to delete your account information at any time, subject to those obligations.
Age requirements
Atlas is for adults. Our site and services are not directed to anyone under 18, and we do not knowingly collect information from anyone under 18. If you believe a minor has provided us with information, contact us and we will delete it.
Changes to this policy
We may update this policy from time to time. When we do, we will change the effective date at the top of the page and, for material changes, notify you by email or by a notice on our site before the change takes effect. Your continued use of Atlas after a change means you accept the updated policy.
